Burden chief in court Friday

Burden Chief of Police Travis Lowe was in court Friday but nothing much really was accomplished. He's to be back in court Wednesday at 8:30 a.m. for another hearing.

Judge Nick St. Peter considered a motion that Lowe's attorney - Chris Rogers - had filed asking that the case be tossed out due to insufficient evidence. St. Peter said he'd take the request under advisement but wanted the court to hear more evidence in the case first.

I wouldn't expect this case to end up being plea bargained. Today in court it was very apparent that Rogers and prosecutor Chris Smith were fairly far apart on how this issue should be resolved. Expect it to end up in front of a jury because, if Lowe wants to continue as a cop, he probably needs this off his record entirely.

Smith, in open court, said he resented Rogers assertion that the state would bring charges against someone without any evidence to support such a charge.

So, I don't see Smith agreeing to a plea that would reduce charges enough for Lowe to remain a law enforcement officer. But we'll see.

  1. A LOT of people are watching this case, and if Smith plea bargains it down he knows it will hurt him politically. I hope we get to see the evidence eventually, and hear the 911 tape. If it turns out Lori Lowe lied to the court to try to interfere with the case against Travis, then she should be charged. The Sheriff's deputies on scene obviously thought there was PC for an arrest, and it would be a slap in the face to those officers to have the case dismissed. And think of how well the City of Burden and the County Sheriff's Dept would work together after that.

  2. and seeing as, how whenever something happens in Burden, even if Lowe goes on the call, the Sheriff's Dept. is always called to do the arresting and of course the paper-work and transporting. This could be bigger than most would know. According to the 911 call log,(on-line) Burden has NOT handled a call, in 5 yrs. Isn't that how long Lowe has been the town marshall? But what do you expect when Burden did a drug bust and "fish-food" was mistaken for weed. Holy Cow! I live outside Burden somewhat, but I am still concerned for this little town. My kids go to school in Burden.

  3. I expected Newscow to have something about this after the court appearance today at 8:30. Did it get cancelled or what?
